Terms & Conditions
These Terms & Conditions apply to your use of StickyPaper Weekly Planner (“StickyPaper” or the “Service”), available at app.stickypaper.co.za.
StickyPaper is operated by Mariëtte van Niekerk, an individual trading as StickyPaper (“we”, “us” or “our”). Our contact details are in section 15.
By creating an account or using the Service, you agree to these terms and to our Privacy Policy and Refund & Cancellation Policy. If you do not agree, please do not use the Service.
1. The Service
StickyPaper is an online family planner. It includes family pages, calendars, to-do and chore lists, rewards tracking, meal and grocery planning, recipes, and other planning features we may make available. The Service is available as soon as you create your account.
2. Accounts and children
An account must be created and managed by an adult who is a parent or guardian. Children may use the Service through profiles managed by that adult.
You must provide accurate account information, keep your sign-in details secure, and tell us promptly if you believe someone has accessed your account without permission. You are responsible for activity under your account.
The parent or guardian is responsible for deciding what information to add to a child’s profile and for the child’s use of the Service. By creating a child profile, the parent or guardian confirms that they are authorised to provide the child’s information and consent to its processing as described in our Privacy Policy.
3. 14-day trial
New accounts can use all features included in the paid subscription for 14 days, starting when the account is created. No payment is taken during the trial.
The trial does not automatically convert to a paid subscription. When the trial ends, you need a paid subscription to keep using the Service. If you do not subscribe, you will not be able to use the Service until you do.
4. Subscriptions and payment
Our current subscription prices are:
- Monthly: R49 per month
- Annual: R399 per year
Prices are in South African Rand (ZAR). The price shown when you choose a plan and confirm your subscription is the full price you pay, and we add no other fees. We are not currently registered for VAT, so no VAT is added. The price and billing frequency that apply are the ones shown at that time.
The monthly plan runs for one month at a time. The annual plan covers 12 months. Access starts as soon as your payment is confirmed.
One subscription covers one family planner, including parents who join it using the family code.
Payments are processed by PayFast (Pty) Ltd, and the payment methods available are those PayFast shows at checkout. Payment processing may be subject to PayFast’s terms and privacy policy. We do not see or store your full card or bank details. PayFast emails you a payment receipt, which is your record of the transaction.
Paid subscriptions renew automatically at the end of each monthly or annual billing period until cancelled. For the annual plan, we email you a reminder about 40 days before it renews and again 7 days before, telling you the renewal date and price and how to cancel. If a renewal payment fails or is late, we may allow a short grace period (currently 3 days) after which access may be suspended until payment is made.
You can cancel at any time using the methods in our Refund & Cancellation Policy. Cancellation stops future renewals; it does not by itself refund a payment already made.
We may change our prices. We will give you at least 30 days’ notice before a new price applies to your subscription. You may cancel before the new price takes effect.
5. Cancellation and refunds
You can cancel your subscription at any time. Details about cancellation, access after cancellation, and refund requests are set out in our Refund & Cancellation Policy, which forms part of these terms.
If you subscribe online, you can cancel within 7 days of your first subscription payment and receive a full refund, without having to give a reason. This is in line with the cooling-off right in section 44 of the Electronic Communications and Transactions Act, 25 of 2002, and we offer it to every customer.
Nothing in these terms or our Refund & Cancellation Policy limits a right or remedy you may have under applicable law, including the Consumer Protection Act, 68 of 2008.
6. Your information and content
You own the information and content you add to StickyPaper, such as events, tasks, lists and recipes.
You give us permission to store, back up, display and process that content only as needed to provide, maintain and support the Service, protect its security, and comply with the law.
We handle personal information under our Privacy Policy and applicable privacy laws, including the Protection of Personal Information Act, 4 of 2013 (POPIA). Please read the Privacy Policy for details about what information we collect, how we use it, service providers that process it, and how to contact us about your information.
If you connect a Google or Microsoft calendar, StickyPaper accesses or changes calendar information as needed to provide the features you request. You can disconnect the calendar at any time. Disconnecting stops future access but may not remove information already added to StickyPaper or changes already made to your calendar.
7. Our intellectual property
StickyPaper and its software, design, text, graphics, name and branding belong to us or our licensors and are protected by intellectual property laws.
While you comply with these terms, we give you a personal, limited, non-exclusive and non-transferable right to use the Service for your family’s personal use. You may not copy, resell, distribute, reverse engineer or misuse the Service, except where the law allows it.
8. Acceptable use
You agree to use the Service lawfully and not to:
- try to access another person’s account or data without permission;
- interfere with the Service or its security;
- use the Service to share unlawful or harmful content; or
- misuse account access to avoid paying for a subscription.
9. Third-party services
StickyPaper may rely on or connect to services provided by other companies, including payment, hosting, email and calendar providers. Those services may have their own terms and privacy policies. We are not responsible for the operation or policies of third-party services, except where applicable law makes us responsible.
10. Availability and changes
We work to keep StickyPaper available and your information safe, but we cannot promise that the Service will always be uninterrupted or error-free. Access may be interrupted for maintenance, updates, technical problems or events outside our reasonable control.
We may change or remove features as the Service develops. We will give notice of a material change that significantly affects a paid feature where reasonably practicable.
StickyPaper is a planning tool. Please keep your own copy of anything that is especially important to your family.
11. Suspending or ending an account
You may stop using StickyPaper at any time. To request account deletion, email us at info@stickypaper.co.za. Cancelling a subscription and deleting an account are separate actions.
We may restrict or suspend an account if we reasonably believe it is being used unlawfully, creates a security risk, or seriously breaches these terms. Where reasonably possible, we will notify you and give you an opportunity to resolve the issue. We may act without advance notice when needed to protect users, address an urgent security risk or comply with the law.
Our Privacy Policy explains how we handle information when an account is closed or deleted.
12. Liability
To the extent allowed by South African law, we are not liable for indirect or consequential loss arising from your use of the Service, such as missed events or lost data.
Nothing in these terms excludes or limits a right, remedy, warranty or liability that cannot lawfully be excluded or limited.
13. Changes to these terms
We may update these terms from time to time. We will update the “Last updated” date and give notice of significant changes by email or in the Service. Changes will apply from the date stated in the notice.
If you do not agree to a significant change, you may cancel your subscription before it takes effect. Your continued use of the Service after the effective date means you accept the updated terms, to the extent permitted by law.
14. Governing law
These terms are governed by the laws of the Republic of South Africa, subject to any consumer rights that apply to you under law.
